Wayne Smith will spend three years in jail and pay nearly $5 million in restitution for his part in what DoJ calls “a wide-ranging conspiracy to defraud the Medicare program.” Smith worked in concert with various co-conspirators through fraudulent Michigan infusion clinics Sacred Hope Center Inc. and Xpress Center Inc. FraudBlawg has consistently reported on this wide-spread fraud and the numerous guilty pleas and sentencing of those involved. At Smith’s sentencing hearing, federal prosecutors presented evidence that he paid kickbacks to more than 40 patients so that Daisy Martinez, Jose Rosario and others could fraudulently bill Medicare through the bogus infusion therapy clinics. Martinez was recently sentenced to 96 months in prison for her role in the scheme, as reported by FraudBlawg. Likewise, the clinic’s doctor, Toe Mynt, was found guilty of conspiracy to commit healthcare fraud for writing fraudulent scripts and orders for unneeded therapy.
