The Department of Justice has intervened in a qui tam whistleblower lawsuit against the Mayo Clinic.  Originally filed in 2007 by former Mayo patients as well as a Minneapolis attorney, the suit charges, among other allegations, that Mayo falsely billed Medicare and Medicaid for pathology tests that were never performed.  Specifically, the DOJ now alleges that Mayo billed the Government for its preparation and examination of “permanent specimen” slides, when in fact no such slides were prepared or examined.  View the whistleblower complaint here:

 In its notice of election to intervene, the DOJ announced its intention to intervene in that portion of the suit but none of the other counts set forth in the original complaint.
