At last, the 17th defendant Xinming Fu, and Irvine physician, was sentenced in his role of giving patients unneccessary respiratory tests. As well as unnecessary tests, patients were given kickbacks in the form of food and cigarettes. The doctors fraudulently billed Medicare and pocketed the money. Fu was sentenced to 30 months in federal prison and $390,000 in restitution. This scheme submitted $15 million in False Claims to Medicare.
